I can appreciate your concern particularly when estates are obliged to raise loans to meet duties, thus limiting funds which could otherwise be used for improvement of farming land. This form of taxation, however, applies not only to Maori land but also to all other land in New Zealand when forming part of an estate. Doer Mr Latimer, Among the matters put to me by the Council during its recent meeting in Wellington was a question concerning estate duty.' It was suggested that because the succession provisions of the Maori. Affairs Amendment Act 1974- came into force on 1 January 1975 (. three months before the end of the extended concessionary period for estate duty provided by section 78 of the Maori Affairs Amendment Act 1967) a concession as regards estate duty in Maori estates was lost. I find, on examining the legislation, that the position is not as was suggested. Section 78 as it was amended in 1973 was not touched and remained in force until iv expired on 51 March 1975. In the case of any Maori dying before 1 April 1975 then, the estate duty payable would not exceed what would have been payable before the 1957 legislation came into force, and gifts of Maori land made before that date would not in any case he brought into the estate of the donor for death duty purposes. It is worth mentioning in any case, that Maori land interests dealt with by the Maori Land Court under section 17 of the Maori Purposes Act (No. 2) 1973, do not attract any duty at all. My knowledge of the nature of the railway. accident in which Leslie Kelly was killed was told to me in Ngaruawahia, but now the surrounding circumstances are to be published by you you should look op the Waikato Times report. I would like to have a record of it for ry records. 5. In the fourth paragraph you give a garbled account, and you quote me out of context in the passage, "Kelly used to tree, el round with you to different people and places". This statement has nothing whatever to do with my work or the Tainui history. It has reference to one or two weekend trips Kelly had with'ine to investigate out of the way Lighting pas in the the Te Kuiti district between the years 1932 and 1940 when we were both living in Te Kuiti. It was as the result of these trips that Kelly learnt that I had amassed a lot of historical material, and he offered to do the typing for me as a quid pro quo for my help ie arranging for visits to the Maori pas about which he made very good plans drawn to scale and wrote articles For the Journai of the Polynesiae Society. With hindsight I have since realised that as a one time reporter or the then defunct "Sun" newspaper Kelly must have it in mind all along to plagiarise my Tainui M/S. As a matter of fact, discussing the matter years later with Johannes Andersen, the then editor of the Polynesian Journal, he told me that he had authorised the publication of a book by. Kelly on the voyage of Marion Du Fresne to New Zealand, and he had to recall the book when he discovered that ,1-?,vas word for word a plagia- rised version of' ing Roth'gZefiglish translation of the Frenchman Croeet's"Voyage to New Zealand".1771-1772. Kelly had copied the part of the Book "Voyage to Tasmania, New Zealand" which dealt with the voyage to New Zealand and given Andersen to understand that the work was the result of research. Johannes Andersen and I were co-members of the Geographic Board, or which I am now the longest serving member. 6. There are fortyore chapters in "Tainui", and I had a hand in all of them. The informants to which Kelly makes reference and which he makes out as having related the various accounts to him were actually elders who had imparted their knowledge to me over a period of twenty odd years before I met Kelly. In some cases the Maori authorities quoted were witnesses in the Maori Land Court in the early years of the Court, and some of the chapters were copied by me from books by Percy Smith White, Cowan etc. Most of the Tainui material in the books by these well known writers were known to me and I passed on the information to Kelly. 7. As the result of the insistence of Sir Apirana Ngata in a letter to Kelly (13/5/1937) for informatior as to sources and authorities Kelly made out a list of authorities in respect of 32 chapters and my name is identified with 21 of than; the remaining 11 chapters are attributed to the informants and writers I have already mentioned. I should mention that the Tainui Maori Trust Board decided shortly after it was established in 1949 to assist in recordirg our Tainui history, and for a time I as Chairman engaged Rauhinga Pikia of Kawhia to do research work in his district. </pre>

In my ohm case I always took great care to choose a time and place-when an elder and I were at rest with the world, and then almost casually a brief question to elicit swine point of history, whakapapa etc will lead on to a very useful and interesting session giving mutual satisfaction to my elder and myself. 10. This reminds me that when Te Puea castigated Kelly she made inquiries of the well known whakapapa elders; Roore Erueti of Whatawheta, Te Kanawa of Kawhia, and Peehitu of otorohanga and others as to whether they knew anything of Kenehuru, whom Telly shows in Table 69 of Tairui (Page 473) as having married Meurant, and who was his (Leslie Kelly's) great-grandmother. In my copy of Tainui. I have noted 'Te Puea has made widespread inquiries and has not been able to get any confirmation of this whakapapa"(. Table 69). tie nOte is dated 1/1/1950. Tawhiakiterangi, whom Kelly has given as the father of his great-grandmother Kenehuru, was the great-grandfather of Potatau, the first Maori King, and being in this line of descent his descendants are considered as belonging to the aristocracy of the wellknown tribe of Ngati Mahuta of Waikato and of the confederation of Tainui tribes. 11. The only result from the inquiries that Te Puea caused to be made was a whakapapa of well known. families of the Ngati. Hoani shorn in the whakapapa: and,oourse,the Families of Wharemahihi and Geo. Aupouri Joseph have no knowledge of Kenehuru in the above whakapapa marrying Edward Meurant. And this discussion on whakapapa reminds me that there are a large number of mistakes in the whakapapa tables as recorded by Kelly. It is hard to understand how he came to make so many errors. Some of the mistakes, I might say, were in my original M/S and it is possible that I did not supply the corrections to Kelly when my attention was dra'n to these mistakes later. </pre>

The )e.:!.ehers selected the firm of Roydhouse to arrange for the printing, and for some reason unknown to me the printed pagcs mace left unattended in the firm's premises. They were ree,vered by Bruce Biggs, and between, him and Colson the book sw bad and my Preface added 13. Another noticeable departure Kelly has made Meer, my chapter chronological order is the creation - and in nmm, instances the upgrading - off-chapters-aad the iheIllsioe ,f some chapters as minor chapters under en upgrat] nurM,i,eu chapter. The nett result has been to :educe the main tors in "Tainui" to MA, whereas the English text typescriat (excluding, of course,the chapter on King Potatau) nuwier in all 89 chapters. The chronological order, too, I have rearranged as the result of later examination of genealoi,ical lines of descent of various contemporary protagonists who figure in the Tainui history. Reverting to the Preface to "Tainui", I was the first to read it carefully to Te Sues and she was very upset to hear all thulsome praises that she showered on Kelly, especially as no one knew better than she did that it vas to me that "the old people have spoken with you freely. Now thanks to you my son, so much of it is in a form that will be readily accessible etc." Te Puea never did much reading in English and I think Kelly banked en this when ha wrote the Preface for her to sisn as document "From Pei fax you to sign for the "Tainui" book I have typed for him. At this point in time I cannot be certain, but I have a hazy recollection that Kelly told me that the name "Te Mutt," which he has used in "Tainui" and which is the name the Preface is addressed to was bestowed on him by Te Puea. In connection with this name you are to understand it is the name of a famous ancestor of the Maori King family, including of course Te-Puea herself, and I cannot imagine it being lightly bestowed on anyone outside the Maori Royal Family, The story of the assassination of Te Putu - in his old age and when he was held in great ace by all Waikato as a very tapu personage is given in my "King Potatau" 35 - 235 </pre>

It is already too long to be reworded, rearranged or retyped. So I shall expect you keep this in mind and not to take umbrage for the strictures expressed. The general tenor of your requisitions, as I saw it, could have been avoided if you had taken proper care with your note taking. It would have spared me a lot of work if you had been specific regarding the details of what was lacking in the notes you had taken. 17. From the outset I felt that it was necessary for me to cover as wide a field as possible, and also to try and anticipate some further queries from you- And this brings to mind the letters my brother received from Sir Apirana Pgata, comprising:- 18. Egmont Street, OHAKUNE JUNCTION 24, 1937 Leslie elly to Sir Apirana Ngata Letter mentions that Reed, Publisher, were to have written about "an of mine et the history of the Tainui tribes. Having the Ethnological Research in mim0, I referred them to you and at my suggestion, they agreed to take the to you. I should be honoured if you would spare some of your valuable time and icok it over. '.The compiling of history is a tedious tast-.As it is, the material gathered by me is not from one man, but histcry gathered in little bits from first one kaumatua and then another. In fact, I feel I can say with confidence that no man in Tainui today knows the history of the tribe in anything like its complete form " Knowing Sir Apirana Ngata's great love for the ancient songs of the Maori, Kelly shroWdly concluded his letter with the following paragraph: -I take also, at this moment, the opportunity of sending you a Maori song which if you have not already in your possession should be useful for your "Kga Moteatea" collections. The song in question is from Nga-Puhi and was composed by Turikatuku on the death of her husband, Hongi Mika." The address of this letter has reminded me that from time 'time Kelly had to leave his home at Te Kuiti to undertake relieving duty at some other railway centre, such as Ohakume Junction and Frankton Junction. It would, therefore, be on one of these occasions he happened to be at Ohakune junction. In no part of his letter did Kelly mention me. So at this point we shall refer to the next letter. 20. WELLINGTON 13th May, 1937 agate to KellaEsg., Egmont Street, OHAKUNE JUNCTION Letter commences "Your letter .was forwarded to my East Coast address and returned here a few days ago.r Reed had already written me about your Tainui History, and on my arrival here a fortnight ago, I obtained the manuscript. The reader -and this is the small class that will take the trouble to read tha material - will rot accept a general statement that yoe have had access to better and more reliable authorities tins: he 21. Sir Apirane's letter goes on to discuss some contrcversial accavets 'negardirg battles of long ago, and some conflicting historazal incidents about the early canoe migrations. The latter also gives numerous hints about avoidieg emonotony, in the sequence of events, whose signiLicence is not: always emphasised and does rot therefore rivet the attention of the reader. I got the impression after reading some of your brief chapters that you could have told us much Acre ." 22. I would cmment at this stage that Kelly had not got my exte,ded M/S at this time, as I vas according t on my Maori. 'text M/S doing some checking or; points of history with Aihe and other elders. Later Sir Apirana poses a question that led to a faux pas type of reply from Xelly in the next letter in which he blamed me for saying, "A certain kind of kokowai, an ochre of a blue hue." Sir Apirana 'had written apropos of this,. "I never heard or read of any kokowai that was not red or some shade of red." Actually it vas shortly before this time when I as one of leading figures in Maori tennis was involved in a lively discussion with Sir. Apirana and other leading supporters of onr Maori Tennis Association as to an appropriate offic-. iel blazer colour for our representative teams, when it was decided it was to be kokowai red. 23. We come now to a passage in. Sir Apiraca's letter which must have given Kelly a jolt (aeepina in mind that he had not mentioned me or my part in the ilTainui" history.; On the second page of his long letter Sir Apirana wrote that be had "awaited with some eagerness the Tairui history which our mutual friend. Pei Jones told me you were at work on." 24 The next letter turned out to be the last letter on "Tainui"; and cormenting on it my brother's note reads; "Api's patience may have cut out towards the end. I noticed Kelly blamed you for telling him kokowai was blue." 25. Egmont Street, ORAKUNE JUNCTION. 'May 12, 19W. Kelly to Sir Apirana Kgata This is s very long letter of four quarto sheets of single spaced typing, It consists mostly of references to points of history that Sir APirera had touched on in his letter. The letter is a long. raibling account abouhe same elders I have already mentioned, and manes out that he spent a lot of time in discussing all the various important historical figures that are referrer to above. The other matter which Sir Apiraea sort of wrueg out of him eat ii: the fore of. ark appendix to his. letter and is headed LIST OF AUTHORITIES, and this canbe cited as proof that I had supplied him with the "Tairei" matereal which he vas to type for me. As already 'stated (Para. 8) is the list he shows me as ore of the aethorieics in 21 of the 32 chapters he has listed. Ter 11 ceapters he gives the names of the authorities as the people who had imparted the bnowledgcU to me but makes it appear that they had passed on the bistory to him direct. At the foot oe the sheet he has noted : "The above is a list from meeoey giving my sourcce of ineoematior. You will observe that I have relice mostly on native accounts." Ye Gods: Wheeever I read the dissembliee manner in which Kelly gave these-, Particulars I feel upset, and this one reason I cannot teest myself at this stage to publicise Kelly's unscrupulous fictions throughout this sorry business. 26. I have decided to withhold the Letters I have been discussing for the time being in. case I seed them later should publicatioe by you lead to some controversial deveeop. emit, or strong reaction. from , perhaps, manbees of Kell-!s family. Before bringing this letter to an end I am having another look at yoirletter to sea whether there is something I have missed out on. 27. Perhaps I should repeat what I told you regarding,.as you put it, "your discovery, from Te Puce. that she had signed the introduction" Lehis poser by you is actually another indication that your comprehension of this subject is very poor indeed, and I almost despair of you being able to make proper use of all the material I have given to youe7 It was I who drew Te Puce's attention to the Preface over her signature is the "Tainui" book. As far as I know Te Puea never bought a copy of the book, or had one given to her. My reading of the Preface to her was the first inkling she had of what was in it. She then told me that Kelly had said that the preface was "from Pei,.etc" (See Para. 15) 28, My illness reached a crisis immediately following the 1943 General Election in which I took part as a candidate for Western Maori, and I vas admitted to the Public Hospital at Hawera. From there I was taken through to the Mater Private Hospital, Auckland, where I was operated on by Sir Carrick Robertson. I was a patient in the Mater for several weeks and later was transferred back to the Hawera Pub- ' lic hospital where I received post-surgery treatment over several more weeks. Even after I was discharged T. had to report at regular monthly intervals for a medical check for about three years. Sly medical checks vas extended to three monthly and by 1950 I was considered well enough for the medical checks to cease. Te Puea visited me in hospital at both Hawera and Auckland. 29. Before closing this somewhat untidy letter, I wish to again revert to what I stated earlier (Para. 2); and that is to say that out of regard. for the high standard of writing one is looking forward. to in the Life Story of Te Puea this Kelly Tainui subject matter should be confined to the aspects I have toeehed on is paragraphs Nos. </pre>

Most of the points I have covered in this letter have direct relevance to "Tainui". Your article on Rgakahikatea was written with a line touch of sensitivity, and a very good understanding of things Maori. Altogether it vas-an excellent tribute from you to our deer old kuia, vga. Yours sincerely PET TO H. jots. The following notes have nothing to do with the Kelly"Tainui" subject matter. While typing this letter I was trying to recall the various matters we discussed with regard to Te Puea and Pomare, and also Te Puea and Ratann case you have no notes on what follows I am offering some material for your portfolio of anecdotes about Te Puea. (a) After the Election when Dr Maui Pomare defeated Henare Kaihau (See one of the whakapapa tables I gave you for the rolationship of Kaihau to Te Puea and Maori King Family) Te Puea, who then lived at Mercer, feared violence from Kaihau (whom she called "uncle") so she went to King Mahuta at his home at liaahi, fluntly. Sure enough Kaihau soon put in an appearance in an angry mood. As he came through the gates y. :of.' the pa Tueoved,elongsidler uncle, the and. , nestled up against him, with her uncle sotto voce saying, "kaua e wehi ki to matua; kaore e tae tana 'are hi to patu i a hoe." (Do not fear your uncle; he will not be able to. make up his mind to harm you.) Kaihau, after calling her names, finally went off muttering to himself. It was on this occasion that King Mahuta had a heart to heart talk with her about her future role as a leader of the people, at the same time counselling her not to usurp the functions of the male members of the Rebuff Ariki (Maori Royal Family) or that of Te Rata, King Mahuta's heir. The occasion was marked by the presentation of the King's gold watch (Old time vest pocket type) to Te Puea suitably engraved with her name and the date, 1912. The presentation was a symbolic bestowal of the leadership role on her. During 1937 Te Puea often called upon me act as spokesman For her, and to carry out various duties on her behalf; and she in turn presented the gold watch to me inscribed with my name and the year,1937. At the same time she handed over some family ancestral heirlooms to King Koroki, and to each of us she handed a kuia feather. The significance of the above anecdotes is that Te Puea - in a Maori situation - never gave a formal speech as was and ,I suppose, still is the case with the highborn women of the East Coast. If she had sometkirg special to say concerning some triba/matter of moment she would always call up a male member of her family, or, if my brother or I was able, she would make known what her thoughts were concerning the point at issue. </pre>

I had reported this decision to Te Puea with. an alder, Poore Erueti to confirm what I had to report. Under Mrs Rusco expert guidance already much hue been added to the furtherance of our original aims. Mrs Nancy Richards who has been involved with Putiki Kindergarten for 14 years and a teacher for 8 years is now Assistant Teacher. We congratulate bar on this appointment. 50 Children in all attend weekly 5 morning end I afternoon sussiors. Mothers of children attending are directly involved and givo their support in the form of n Mothers, Club. We feel tribute must be paid to Mr John Visser, Chairman of the Building Committee for his dynamic leadership and Mr Michael Payne, Architect and Advisor for services rendered beyond hie profession. You will be pleased to knot, our Patron, Lord Porritt of Wanganui and Lady Porritt, visited the Kindergarten and expressed their delight at tho progress made and wished us well for the future.
