Decision This is an application under Part X1V of the Maori Affairs Act 1953 for the investigation of the title to customary land and for the making of freehold orders The land concerned is Motutaiko Island in Lake Taupo containing approximately 28 acres. The Court has first to determine whether or not the land is customary land and I find as a fact that tutaiko Island is customary land. Although it is not row occupied there is no doubt that the land has never been held otherwise than by Maoris in accordance with Maori custom. The applicant is Hepi Hoani Te Ueuheu who is the present paramount chief of the Tuwharetoa tribe and his case was presented with admirable clarity by Dr hei Jones, hi,self a person of great knowledge of Maori History and genealogies. The claim for a freehold order is made by the members of P. 117 the Ngati Te Rangiita subtribe who arc descendants of Te Rangitua-matotoru. There were many elders of the subtribe present in Court. At the conclusion of the hearing the persons present were invited to comment on what they had heard and there wero no dissenting voices. The application, the Court was informed, had been widely discussed in the Taupo area. The evidence was that the island had been held by the Ngati Te Rangiita subtribe without interruption until the present. The island is of considerable historical interest and has been used as a burial ground for members of the subtribe including the founder , Te Rangi-tua-matotcru. What could be described as the headquarters of the sub-tribe is still situated on the mainland near to the island. It appears that, apart from sporadic raids, nothing has taken place which could be said to threaten the rights of the subtribo to the island. The finding of the Court therefore is - (a) The land known as Motutaiko Island is customary land within the meaning of the haori Affairs Act 1953; (b) The owners of the said land arc members of the Ngati Te Rangiita subtribe who have succeeded or are entitled to succeed in accordance with Maori custom to Te Rangi-tuamatotoru and his successors according to Maori custom; P. 118 (c) A Freehold order under Part X1V will be made by the Court on the presentation of the lists of names submitted for inclusion in the title and their relative interests. Pei Te Hurinui Jones: Nay it please Your Honour I appear on behalf of the applicant, kepi Hoani Te Heuheu. In this case the applicant - who is paramount chief of the Tuwharetor tribe - is representing the members of the Ngati Te Rangiita subtribr who are descendants of Te Rangi-tua-matotoru and on whose behalf the claim is being made for ownership of Cotutaiko Island. So far as we are aware, Sir, there are no counter-claimants, and I am proceeding with the case on the understanding that the evid, that will be given is for the purpose of formally establishing the rights of the Ngati Te itangiita to ownership of the island, and to satisfy the Court that their claim is a valid one and that they are entitled to a freehold order in respect of the title to Motutaiko Island. Of course, if there should be any counter-claimants we respectfully ask forthe Court's indulgence to allow us to reserve the right to recall witnesses or to adduce fresh evidence in rebuttal. On this point, Your Honour, I think 1 shogld mention that evidence will be given concerning discussions having been held in various places pn many occasions regarding Ngati Te Rangiita's claim. It may be taken , therefore, that sufficient publicity has been giver to this matter, and that all sections of the main tribe of Tuwharetor of the Lake Taupe district are aware of the Ngati Te Rangiita case for Notutaiko Island. I now desire to present the Claimant's case formally, and oil: commence at this stage by giving evidence myself concerning the whakapapa or genealogical tables on which the claim to ownership of Motutaiko Island will be based. It has not been possible to keep track of all the families who have moved away from the tribal area. I should point out, Your Honour, that in a few instances namesof deceased persons who have died leaving issue are in the whakapapa and will appear in the versus lists that are to be lodged later. In these canes I have not been able to get reliable evidence as to the issue of these deceased persons, These genealogical tables have been examined by the family groups concerned and no objections have been made. The whakapapa tables, comprising six sheets, that I now formally lodge with the Court are to the best of my knowledge and belief correct. Whakapapa produced. P. 83 The founder of the hapu concerned is (12-15) Te kangiit, he lived in early 1700's To Mangi-tua-matotoru, the ancestor under whom the claim to Motu-talks Island is being made, came from a long line of paramount chiefs of the Tuwharetoa tribe. The Tuhoe warparty invaded Taupe, and inflicted a severe defeat on the Tuwharetoa tribe at Orona, and once again Te Rangi-tua-matotoru had to exercise high diplomacy which eventually brought about a peace-making which has endured down succeeding generations.
