The: your Petitioners were owners of undivided shares in one or more of these blocks of Maori Land, or are the next of kin of former Maori owners who are now deceased. The land is situate in the Auckland Land District, Waiariki Maori Land Court District in Hurakia and Marotiri Survey Districts. 2. THAT in the years prior to 1920 the Crown endeavoured to pur- chase these lands by resolution of the "assembled owners" but the owners as a body refused to sell at the price offered by the Crown. In 1921 the Crown began to purchase undivided shares by transfer from individual owners. These negotiations continued right down to the year 1930. '3. (e) The ori owners were debarred from negotiating any alienation themselved as there was a proclamation over the lands prohibiting alienation except to the Crown. 10. The question for opinion touches certain petitions of right filed in the Supreme Court by or on behalf of Manta Methane and other former owners of undivided intereete in the abovementioned 'Native Lands. Their interests, held by them under,e Partition Orders of the Native Land Court, were purchased by the Crown under the authority of Part In of the now-repealed Native Land Act 1909 and its amendments at various times between the years 1921 and 191, and during that period transfers, as yet unregistered, of their respective interests were executed by them in favour of the Crown, By section 371 of the Act of 1909 (re-enacted as section 448 of the consolidating Act of 1951) the Crown was authorised to purchase undivided shares in Native land. By section 372 (now section 452 of the Act of 1931) conditions as to price were imposed on the Crown: the section reads as follows: "No interest of a Native in Native land shall be purchased by the "Crown under the authority of this Part of this Act at a price "which is lees than the amount at which the capital value of that "interest is valued under the Valuation of Land Act, 1908, in the "district roll which is in force under that Act at the time of "the contract of purchase. "If no such valuation is then in force, the Native Lend Purchase "Board shell require the Valuer-General to make a special "valuation Of the interest proposed to be acquired, and the "interest shall not be purchased at a less price than the amount "at which it is so valued. "No purchase shall be invalidated by any disregard of the "requirements of this section, but the deficiency in the purchase "money shall constitute a debt due by the Crown to the owner of "the interest, and recoverable accordingly in proceedings "instituted within two years after that interest has become "legally vested in the drown." The question is whether the Crown complied with the requirements of this section as to price of the interests acquired. Each of the petitions is based on the contention that in respect of the land to which it relates there wee at the time of purchase and transfer no valuation in the district roll under the Valuation of Land Act 1908 and that no special valuation ?.1 </pre>

It is claimed in each petition that the price paid 13/ the Crown and accepted by the vendors wee in fact inadequate and that the deficiency constitutes a new-recoverable debt due by the Crown to the selling owners. I am asked to assume that the petitions were filed within the period of limiatation prescribed by subsection 3. The pleas filed in answer in behalf of the Crown in each case aver that there was at all mater1al times an entry in the District Roll which was in force under the Valuation of Lend Act 1908 in respect of the relative land, such entry being.: dated the 31st day of Manch 1916, end also that a further valuation report was obtained from the Valuer-Oeneral in respect of sucand on the 28th day of January 1920. The second half of these pleas may amount to a contention that the "further valuation report" therein mentioned was a "special valuation" within the meaning of subsection 2, if the first half of the plea should fail. However that may be, it is plain that if the facts justify the first half of the plea, there has been no disregard of the requirements of section 372 as to price and the petitions moat fail. It appears that at the times of purchase and of transfer the only entries in the District Roll concealing these lands were entries dated in 1914 and 1916, before the awing of the Partition Orders which defined Tihoi 38 88 Roe. 3, 4, 5 and 6 and ascertained the interests of the petitioners therein. I do not find it necessary to set out the actual entries, There was no valuation of Tihoi 3B 8B ae such and certainly no entry as to individual undivided interests. Mr. Jack, however, has had compatitations made by a surveyor of the land in the Blocks in the relative survey Districts and finds (what I assume to be the fact) that the lands in the Valuation Roll entries of 1914 and 1916 on which the Crown relies - although not under the same titular description or the same ownership r are the very lands in which the petitioners held the undivided interest sold by them to the Crown and in respct of which they now claim. </pre>

It is not contended that the price paid by the Crown was in the case of any of the purchases leas than a proportion of such valuation accordino the undivided shares held and sold by the respective transferors: indeed, I understand it to have been rather more, though still far below values indicated by a separate assessment of standing timber in the course of recent proceedings for partition as between the Crown and those owners who had not Mild their shares. On these facts I em of opinion that there was at all material times with respect to the interests purchased a valuation under the Valuation of Lend Act 1908 in the district roll in force under that Act and that the price paid was not less than such valuation. I think that a valuation of the whole is necessarily a valuation of an aliquot undivided part or parts. Given the value of the whole, clearly the value of, say, an undivided half is obtained by dividing by two and obviously the same process of simple arithmetic applies for, say, 1331 undivided shares out of a total of 112981 shares of a given aggregate value. The statute must be read and construed reasonably.'. It expressly authorised the Crown to buy undivided interests. It specified the District Roll as the criterion of value, if such roll contained an entry in force as to the interest purchased. In this case the District Roll by showing the value of the whole showed, by neceesery implication, the value of all aliquot parts, and, in my opinion, the statute is satisfied. Certum est good certum reddi potest. To construe the statute otherwise would lead, I think, to absurdities. Suppose that a parcel of native land, singly owned and duly appearing valued in the owner's name in the appropriate District Roll passes to several devisees as tenants in common in aliquots shares (equalor unequal) under his will and the Crown purchases the interests of some of the devisees which the roll is still in force but not yet altered - could it be argued that because the individual vendors or the values of their respective interests did not appear in the roll at the time of the contract of purchase that the Crown could 06, </pre>
