Dear Sir, .:aikato Confiscations In confirmation to my letter to you of the 6th April instant, replying to your letter of the 3rd idem; the Royal Commission which investigated the matter of the Confiscations in 1927 made its recommendation in respect of the Waikato lards in the following words, namely: "Our recommendation is that the excessive confiscation should be compensated for by making a yearly payment of 33000 to be applied by u Board for the benefit of the Natives of the tribes whose lands were confiscated." The principle contained in the recommendation of the Royal Commission with regard to the application of any compensation granted by the Government was given statutory recooniticn in section 20 of the Native Lind Amendment and Native Lund Claims Adjustment Act 1928) now Gection 45 of the Native Purposes Act 1931). This section provided for the constitution of a Board to administer any payments which might be granted and gave the Governor-General in Council poser to make regulations regarding inter alga the administration of the funds and provided that the said Board when constituted shall administer all funds held by it for such Eeneral nurposes as are set out in any Order in Council coiTaitU-Ciiii the Board and that subject to such general purposes it shall be within the powers of the said board to finally determine shat may be a proper object for which a payment may be made out of the funds. It is certain that the Government would not agree to any compensation payments being distributed to the individual members of the tribe and provision would be made by regulations for the moneys, if, and when paid, being applied for the general benefit of the whole of the tribe as was done in the case of the Taranaki compensation moneys and the payments to the Arawa District Trust Board and the Turrharetoa Trust Board. This principle was agreed to by the Tribal representations who met the Government at Wellington in 1539, when the matter of the payment of compensation was being discussed. The Rion. the. Prime Minister also indicated in his speech at Ngaruawahia on the Oth March last that some form of Control of the expenditure of any compensation moneys which might be paid would have to be set up on the lines of the present statutory provisions. Waikato Confiscations I have to thank the Prime Minister for the letter signed on his behalf by you on the above matter of the 25th ultimo, and I an pleased to note that during his absence in England any communications in regard to the above matter are to be addressed to you. At this moment, it is desired that some definite move should be made in the direction of reaching a common understanding as to the nature of our mutual approach to a settlement of this matter. As the result of the Prime Minister's pronouncement at Ngaruawahia on the 8th March last, the tribe held a meeting after the Price Minister's party had left, with the result as advised in my letter to the Ron. the Native Minister of the 15th idem. The Prime Minister's clear state- ment that the suggestion of giving back the land or revenue therefrom was impracticable, following as it did a similar declaration by the former Government, was stressed at this meeting. To impress the Maori mind, it was pointed out that with similar declarations from Governments representing the two principal schools of thought in the political world, it was the height of folly to maintain an untenable argument in the wild hope that some political party would arise to give effect to their claim. Recently at a Maori meeting at Otorohanga, (28th to 30th March last), some from the same element announced, so I have since been told, that it was their intention to put forward a claim for a division of the compensation moneys, when paid over by the Government. This, obviously, would open up an endless source of litigation and expense to all concerned in order to detenaine the exact proportions to which the various groups, families or individuals are entitled. This suggestion in y opinion betrays a selfish attitude towards the matter, and gives weight to the inference, hinted at by some of our people, that these individuals have put forward their former plea for the return of the lands in order to mislead some of our people and to distract attention from their principal objective of getting personal advantages by way of individual payments of compensation moneys. The idea of "dividing the spoils" was, I understand, at one time considered in connection with other similar tribal claims (Rotorua, Taranaki and etc.,) but had to be abandoned us being impracticable. It would only, among other things, encourage unscrupulous persons to advance their own

I presume it is not desired to have too big a personnel for the Committee which is to investigate and report as to the amount of the compensation, as suggested by the Prime Minister, and at present the Waikato tribal representatives for the Committee is still unchanged with myself and P. to Hurinui the only nominees. Neither is it intended in the meantime to incur the expense of securing legal representation, which the tribe can ill-afford. Your decision as to the setting up of the Committee and the time and place for meeting will be appreciated at this juncture, or, perhaps, you may consider it desirable for us to confer with you as a preliminary to the setting up of the Committee. At this moment, it is desired that some definite move shoold be made in the direction of reaching a oommon understanding as to the eaters of oar mutual approach to a settlement of this matter. As the result of the Prime Minister's pronouncement at egareavahla on the 8th March last, the tribe held a meeting after the Prime Minister's party had left, with the result as advised in my letter to the Rohe native Sinister of the 15th idea. The Prime Minister s clear state- ment that the suggestion of giving back the land or revenue therefrom yes impracticable, following as it did a similar deolaration by the former Government, was stressed at this meeting. To impress the Maori mind, it was peinted out that with similar declarations from Governments representing the two principal schools of thought in the politisal world, it vas the height of folly to maintain an untenable argument in the wild hope that some political party would arise to give effect to their claim. Recently et a Maori meeting at otorohamge, (28th to 30th March last), some from the same element announoed, so I have since been told, that it was their intention to put forward a claim for division of the compensation moneys, when paid over by the Government. This, obviously, would open up an endless souree of litigation and expense to all concerned in order to determine the exact proportions to which the various groups. families or individuals are entitled. This suggestion in my opinion betrays a aelfish attitude towards tae matter, and give weight to the inference, hinted at by ease of our people, that arose individuals have pot forward their former plea for the return of the lands in order to mislead some of our people and to distract attention from their principal objective of getting personal advantages by way of individual payments of compensation moneys. Sir, The Waikato Confiscation I am very pleased indeed to acknowledge receipt of your letter of the 23rd ultimo. As you have expressed your intention of continuing the conversations on the above matter from the point at which they wore left off in October last, I shall be pleased to await your convenience as to time and place as indicated in your letter. May I, however, in order to clear up one or two matters, say that the tribal attitude - which I have always tried to gauge as accurately as I can and which I am keeping in view during the negotiations with the Government - presents a difficulty that urges me to strive for a settlement that will absolve our family from any future criticism that I had not obtained the best possible settlement on behalf of our people. You will. therefore, appreciate my anxiety in the 'tatter and my reason for pressing for inclusion of the proviso "..that such settlement is to be without prejudice to striving for an ultimate settlement at ?358,666," and I had hoped that the late Goverment would have taken the necessary steps to effect a settlement for the time being in accordance with my letter to the Rohe Prime Minister of the 10th October last, (Dopy attached). I understand that the settlement made with the Taranaki people also included a proviso with regard to a final settlement at a higher amount than the ?5000 per annum now being paid, and I assumed that a certificate as required under Section 49 under "The Native Purposes Act 1931," would likewise have been completed to cover A settlement for the payment of ?5000 annually for the time being until such time as the Government is prepared to discuss a lump sum settlement, and such settlement to be without prejudice to striving for an ultimate settlement at ?358,666 for the Waikato tribes. The Right Hon. the Prime Minister, W4LLINGTON. 31r, Waikato Confiecations I am pleased to note from your telegram of the 8th instant, that the Government is prepared to discuss the Principal sum at some future date and that the payment of ?5000 per annum is not to be regarded as commitment in respect to amount the principal sum. This we have taken as leaving the settlement at ?5000 per annum as a settlement for the time being and that it is to be without prejudice to striving for an ultimate settlement at the principal sum of z358,666. The Government's desire to fix a principal sum is fully appreciated but in view of the uncertainty of an annual income of ?5000 per annum being derivable from a principal sum of ?100,000, I had no alternative but to ask that a settlement for the time being, based on that amount, be left open. Furthermore, I would be acting against the general tribal feeling on the matter if I failed to place on record that any settlement at this juncture below the principal sum of ?358,666 is not to be regarded as the final settlement. Following on receipt of your telegram, a fully representative meeting of the Waikato people vas held last night, when the full history of the negotiations with the Government was given by myself and Te Hurinui. At this meeting it was resolved that the final consideration and decision was to be left to members of my family and Tarapipi Taingakawa. This resolution, by the way, was similar to a resolution passed at a meeting of the Waikato tribes at Ngaruawahia on the 21st March, 1935 A meeting of our family and Tarapipi Taingakawa took place this morning and it was unanimously agreed upon that all steps taken by me in the negotiations with the Government were to be approved of. Dear Sir, The Waikato Confiscations Referring again to your letter of the 30th March last and to my reply thereto of the 4th April instant; the position with regard to the settlement of the question of the payment to be made to the Waikato tribes in respect of the recommendation of the Royal Commission which investigated the matter in 1927 would appear to be that on the 7th October 1935, the Ror Forbes who was then Prime Minister, in a letter to you suggested that the following be aooppted as a basis for settlement: "The Government to pay ?5000 after t A r t ncia e: 1 - an per annum ereafter. The Crown reserves the right to pay off the capital sum of 100,000 at any time in full and final settlement of all claims. Olen the capital sum is paid, the annual payments of ?5000 will cease." On the same day you wrote to the Ron. the Prime Miniater stating that:- "Whilst I am prepared to accept a settlement for the time being of ?5000 per annum I am constrained to again bring to the Government's notice that such settlement is to be without prejudice to striving for an ultimate settlement at ?358,666. The Government's suggestion to fix the principal sum at ?100,000 as a final settlement is therefore not acceptable and I shall be glad if the Government will omit any reference to a principal amount at this juncture." On the 8th October, Mr Forbes telegraphed you as follows in reply to your letter of the 7th idem: "Government desires to fix a principal sum in order to make your position secure against risk of reduction of an annual vote in time of financial shortage. In meantime. Government offer stands but prepared to discuss principal sum et some future time. Payment of ?5000 per annum not to be regarded as commitment in respect to amount of principal sum."

"Z5000 per annum based upon a principal sum of ?100,000 which sum it was stipulated the Government should have the right to pay off at any time in full settlement of all claims and when so paid off the annual payment of ?5000 would automatically cease." This offer was not accepted by you but you agreed to accept the ?5000 per annum meantime without prejudice to striving for an ultimate settlement at ,',358,666. However, you were later informed that the Government's offer stands but that the Government was prepared to discuss the principal sum question at some future time. The position appears to me to be that the Government's offer has not yet been accepted by you as representing, the Waikato tribes although you have notified your willingness to accept the payment of ?5000 per annum for the time being leaving it open to you to press for a final settlement at ?358,666. The authority for negotiating a settlement of the payment of compensation in respect of the Waikato and other confiscations is contained in section 49 of "The Native Purposea Act 1931" but there are two conditions precedent to any payment being made, namely.- 1. That no payment can be made unless and until the amount to be paid has been appropriated by Parliament for the purpose; and 2. That the Native Minister is required to give a certificate under hie hand that the particular grievance has been settled in the manner set out in the certificate which certificate is to be accepted as conclusive evidence that the matter hae been so settled." As the matter stands at present I am unable to certify that it has been finally and conclusively settled but I am agreeable to continue the conversations from the point at which they were left off in October last to see whether or not it is possible to arrive at a basis of final settlement acceptable both to your people and to the Government. I will endeavour to arrange a time and place for meeting you and your advisers as soon as my present engagements will permit and I will have pleasure in informing you in due course when it will Le possible for me to meet you.
