Tena Koe, - SHSLLFISK REGULATIONS - My Board is deeply concerned at the fact that there are anomalies in the above regulations which unjustifiably interfere with the constitutional rights and privileges of the individual. No doubt your Board will agree. In this respect, my Board has made an initial approach to the Minister for Marine and our submissions are as follows:- We feel that the Nation as a whole is aggrieved by certain anomalies within the regulations and for the following reasons, we believe this to be true and factual. My Board contends, that the regulations offend when related tc the individual's legal quota of shellfish as opposed to the legal daily quota per vehicle or party of three or more persons. We concede the fact that the statutory rights and privileges of individuals are fully protected to a point but lost to individuals when they use a private means of conveyance where the number of persons exceed three. Should you be familiar with the regulations, you will note that a legal daily quota applies to the individual but this quota is drastically reduced when applied to the legal daily quota per vehicle. Take the humble toheroa for example, the last legal daily quota per individual being 10. 5 persons, without using any means of transport can get their legal quota of 50. Should those 5 persons use a private means of conveyance, their legal quota is then reduced to 3(1, this being the quota applied to vehicles during the last toheroa season. Therefore, in the above example, any two of that number of persons have been deprived of any statutory liberty, despite the fact that such persons have not committed any misdemeanours. We believe, that in any democracy, the statutory privileges of the individual as well as the freedom of The individual to be sacrosanct and inviolate to the point where the individual can only be deprived of such privileges and individual liberties, should such individual commit a misdemeanour for which there is some remedy at law, We contend that this concept is over-ridden by the shellfish regulations. Reference is made in this letter to &quot;private means of conveyance&quot; and this due to the fact that the law will grant special dispensation where individuals use licensed means of transport and where individuals are fare paying passengers. Such individuals are legally entitled to their individual quota and it is implicit in this case that the per vehicle restriction does not apply. Again, we argue, that in the above instance, the law discriminates between ore individual and another for no apparent justifiable reason. We are cognizant of the fact that there must be a certain restriction of individual liberty, because by this very restriction, there ultimately results a greater liberty because it is safeguarded. 2/.

However, we feel that any such restriction on individual Liberty must first be fully justified before such restrictions are imposed on the people. Should unjustified restrictions be imposed by the State, such imposition then offends the public as a whole and the offending regulations should be amended. As such, we have asked the Minister to investigate the position as applied to the per vehicle quota and have asked that the regulation be amended whereby a per individual quota only, applies. Our submissions have been acknowledged by the Minister and he has advised that he will be replying in full at a later date. A copy was also sent to the Member for Northern Maori, Matiu Rata, who has replied to the effect that he will personally take the matter up with the Minister. That is the position at present. As lay people, our submissions could literally be shot down in flames by the Minister, as we may not be fully conversant with the niceties of the law in respect of constitutional rights of individuals as well as rights granted to the State, by statute, to impose its will on the people, at random. However, notwithstanding the foregoing remarks, I iterate my Board's contention that it is of the opinion that the offending regulation mentioned herein, is constitutionally and morally wrong and we solicit your support in bringing this matter to a head. ,Manuera SECRETARY
