Kingi - Clerk/Interpreter 2 HAROHARO 9 AND OTHERS Section 435 and Section 438 COURT: Refer Rot. 150/186-189 of 1970. This application, lodged for purposes of convenience by the Deputy Registrar pursuant to the power conferred on him by subsection 1 of Section 27 of the Maori Affairs Act 1953, has its genesis in a worthwhile working arrangement struck by the Rotorua County Council with the Maori owners of thirty-three blocks of Maori freehold land all now lying idle and unproductive. So far as the Maori owners are concerned it is significant that after more than usual notification of the matters in hand no Maori owner is in opposition to the general nature of the relief sought in the prayer to the application. At the very outset it is as well to say that there is no evidence that the owners of the land have neglected to farm all or any one or any combination of the lands or otherwise manage the same with due diligence and that in consequence of their neglect the lands have not been used to proper advantage. The fact is simply that the lands are not and never have been capable by ordinary and reasonable standards of being used with advantage for agricultural or pastoral or horticultural purposes. It is clear, on the other hand that their profitable future, happily both in the private and the public interest, lies in their utilization for long-term forestry purposes. The instant application is directed to the making by the Court of a series of orders empowering representatives of the Maori o,mers to treat for and conclude with any interested forestry concern arrangements for the establishment upon the lands of an exotic forest of some 16,454 acres. On the material before it the Court is satisfied, as the owners are satisfied, that these lands can be more conveniently worked or dealt with if held in common ownership under one title. In terms of the consent of the Maori Trustee (MT 12/677 of 2.1970 - folio 9 on Ct file 10184) there is an order under Section 438(3)(c) of the Maori Affairs Act 1953 terminating the trust constituted 14th November 1968 as to Haumingi 13B and revesting that land in the beneficial owners in their respective shares freed from the Trust. Order Section 34(10) for immediate release. The Maori Trustee, since the date of trial, has filed a claim for 110 costs with interest at 6 as from 1.1969: The Court understands the Maori Trustee intends to exercise. some Statutory provision available to him under the Maori Trustee Act 1953 to secure payment. Whatever step he may or may not take in that direction, leave is reserved the Maori Trustee to make to the Court on or before 31st May 1970 such application to that end as he deems meet. 420-2- Haroharo 9 ors the schedule as appropriate only for amalgamation purposes inter beneficial owners since in them there is an overall common denominator, but that denominator, in the experience of this Court, does not represent the value of those lands for forestry purposes and dealings with third parties such as here contemplated. The lands are contiguous and are so located one to the other as to constitute a compact single area capable of being the more profitably exploited in the owners' interests. Some of the owners of the former Salons B2B5 wished to have excluded from the scheme some 10 acres of that land upon the premises that such had a marked potential for subdivision for their own personal domestic housing needs in the forceable future and not for alienation outside their own ranks. The land is zoned &quot;rural&quot; and it is unlikely to be re-zoned as &quot;residential&quot; for some years yet. However the Court in view of the special circumstances urged upon it is able to meet those owners request and that it has done on strict terms. 451-3- Haroharo 9 ors 2. That the exchange of Crown land for lands of the trust could be beneficial to the Maori owners as being more suitable for afforestation purposes; 3. I ask for the trust instrument to be amended to include provision for the Trustees to exchange land for the Crown land in schedule of 27th February 1970.&quot; Counsel appearing in support of the amended Notice, not having been instructed on the points, was unable to inform the Court what Crown lands might be available for exchange or even their locality. The Court sympathises with the dilemma in which he found himself - a dilemma which should never have presented itself, since this Court cannot believe other than that his principals at both Hamilton and at Wellington had knowledge or means of knowledge of the negotiations under way for some years past within the Maori owners' ranks; and the special facts that his principal at Hamilton at all material times was and still is the functional Head of both the Lake Rotoiti Scenic Reserve Board and the Lake Okataina Scenic Reserve Board. One thing is certain and that is that the unanimous will of the Maori owners will not be unduly delayed by last minute interest in long outstanding issues. However, there will be inserted in the Trust Order a term generally along the lines suggested by counsel for the Lands Department, but that term will be unequivocally limited in point of time - and time will be strictly of the essence. The way is open for the Department of Lands Survey to &quot;keep pace. On several of the lands there are isolated stands of indigenous timber trees or the odd minable tree. It is meet that the trustee should be empowered to promptly sell them for removal. Accordingly provision is made to that end. As to subsection 6 of Section 435. There are apportionment and adjustment orders as follows: Charges/Mortgage given by Ngapoti Mamaku or Takuira over interests in former Waione C4 now over interests in Rotoiti 14 and Waione C4A; (ii) Charges/Mortgage given by John Pohio over interests in former Waione C4 now over interests in Rotoiti 14 and Waione C4A. The Court for sufficient cause may at any time on application or of its own motion upon the giving of such notice (if any) as it may deem fit remove from office any advisory trustee. The advisory trustees appointed by the Court on the 17th day of March 1970 shall retire as follows: (i) At the Annual General Meeting held in the second calendar year after a year in which the trust was constituted one-third of those advisory trustees shall retire; (ii) At the following Annual Genera] Meeting, an equal number of those advisory trustees shall retire; (iii) At the next following Annual General Meeting, the balance of those advisory trustees shall retire. At the same time as the Partition Orders were made the Court also made road line order for the laying off of 3 roads as described in the order. subsequently the land was re-partitioned to provide for lend being given up to the Crown to pay for the partitions but no roads were construsted. 40 years or more later the Order was amended by the making of en entry &quot;3 roods made accordingly. Amended pursuant to Section 60 Maori Affairs Act 1953&quot;. In 1919 the Lands and Survey Department became interested la purehasing the Tihoi Bloeks and meetings of owners were held at Sokol on 9-12-19 to oonsider sales to the Crown. All resolutions to sell were rejected unanimously by the owners because of the low pries; averaging loss than A2-00 an air. following this the Crown issued a proclamation prohibiting senors from selling to anyone except the Crown and further meeting wort called in August of 1921. At none of these meetings was a resolution to sell to the Crown carried. It appears that, se previously, apart from any other eonsideration, the prices were considered to be too low. In fact the nee-sellers were located in two blocks in Kawakami Bey namely Tibet A containing 1600 acres and Tibet 3118 112A1 containing 1052 acres and 3 roods. The latter block has a frontage to the lake. The exchange was confirmed by tbs Court in 1956 and it was a condition that the Crown construct an access rood stalled to the northern boundary of Tibet A bloat and formed for a further mile towards the lake. MOIL MOLDING WELLINGTON. . d 0 AUG 1950 Pei Te Hurinul Jones, Esq., Box 78, TAUARUIqUI Dear Sir, TIHOI PURCHASES Referring to your letter of the 3rd July, I should like to make it cleahat my decision that no further action should be taken in this matter was nut based on any views of my predecessor, but was reached independently as a result of my own examination of the whole history of the purchases. Although you have compered the 1946 values with these at the time of the last purchases in 1i29, to be quite fair I think the co,parison should be made with the time when the bulk of the interests were purchased; that is, between the years 1921-1923 ,hen 8; of the shares in the timber blocks were acquired. The only real guide to values of bush areae at that time is the sale price of land in the sass locality. In this case there are figures available in respect of a neighbouring block, Tihoi 3B8A, containing 2610 acres of bush and 1549 acres of open country. This was purchased from the Maori owners in 1919 for ?1050, a special valuation at the time showing a capital value of Z1046, or approximately 5/- per acre. In the same year the purchaser, Ferens, transferred the land to one Wells for 21100 and in 1935 Wells sold to W. Burgess for Z174.11 - a little over 8/- per acre. The price paid by the Crown of ?1 per acre for bush lands and 6/- per acre for open lands compares more than favourably with the prices paid by private purchasers in that case. From a perusal of the records it appears that the Lands Department made a conscientious effort to arrive et a fair valuation before negotiating for the purchase. The Government valuation was 5/- per acre and in 1920 the Valuer-General advised that there had been no substantial increase in value since the date of that valuation, namely 1916. A special valuation, however, had been made earlier and showed the bush areas at 10/- to 15/- per acre and the open land at 5/- per acre. The Lands Department then arranged for one of its field officers to inspect the land and he considered that the bush country was worth Z1 per acre and the open country 6/- per acre. As you know, that was the price finally paid for the shares purchased by the 0 sun. As en indication of the low value placed on bush country at the time, I am informed that bush-clad areas in the King Country were sold by the Crown in 1921 at prices

It is probably not an over?statement to say that in the twenties the Tihoi bush was almost worthless as a commercial proposition and I do not think that 1946 values can be said to give any indication at all of the actual values at the time of the purchases. Not only has there been an increased demand for timber in the past 15 years, but the cutting out of easily accessible bush has led to a tremendous increase in the value of areas previously considered too remote to be economically worked. Such a great increase could hardly have been foreseen in the twenties and it hes been established that there can be no claim for compensation in respect of en unforeseeable increase in the value of land subsequent to a purchase.
