TAUMARDNUI Dear Sir, re: Rangitoto Tuhua 6802D2B2B1C - Mangu Waretini deceased 1947 - Sale to Mrs Boulton You will probably remember that I wrote to you in June 1969 re the difficulty I was having in completing and registering the transfer to Mrs Boulton provisionally confirmed in 1947. On my telephoning you in March 1970, you advised me that Harimate would agree with whatever Tom Perawiti agreed to, which was, in effect, that the sale made by Mangu Waretini should be completed with no further consideration being made to the present owners. When you made the application to the Chief Judge to bring Harimate into the succession to Mangu, the succession order made to Mangu on the 2nd day of June 1965 was based on the original succession order made to her on the whole of the 291 Block on 12th November 1952 (Oto 77/270-1 + 78/219) although succession orders had thereafter been made(prior to the partition orders of 24th March 1960 affecting lA 18 and 1C) to the then deceased owners namely Raupi Waretini, Hineaupounamu Waretini and Hapina Ponaka Waretini. The partition orders after 1A, 1B and 1C are recorded in Oto 83/248 et sea. and the owners of 1A and 1B were as set out in the attached memorandum the original of which is held in supporting papers in the Maori Land Court folders affecting the blocks. The succession to 1C was made in favour of Mangu Waretini deceased in order to protect the provisionally confirmed transfer to Mrs Boulton as shown in the said Memorandum. The delay until 1960 was caused through the survey made many years prior to ,947 of the original 2B block of some thousands of acres being found to be incorrectly plotted insofar as the Mangapehi Stream was concerned, the point of entry near Mangapehi and the point of exit near Kopaki being correctly plotted but the course of the stream through the block was, as far as I can now remember, plotted as veeri ng in an easterly direction whereas in fact it was veering in a . All the areas of the partitions affected by the stream had been made to the incorrect plotting of the stream from either side with the result that some were upto many tens of acres incorrect. It cost some E1200 to correct the survey and re-partition and this took until 1960. There was further considerable delay in completing survey payments and it was not until late in 1963 that partition orders for the various blocks including 10 were forwarded to New Plymouth for registration with further delay so far as 10 was concerned and at the beginning of 1967 when I tried to register the transfer I ran into the troubles with the Land Transfer Office as shown in that Office's copy letter of 3rd April 1967 which I have already forwarded to you. I did not know of the succession order of 2nd June 1965 until late in 1967 and until recently I was at a loss to know how to rectify the position. It would appear that no mention was brought to your knowledge by the Court of the parition order of 24th March 1960 which expressly reserved 1C in Mangu's name or of the reason therefor and as practically a last resort I am considering applying to the Chief Judge for an order cancelling the succession order of 2nd June 1965 and if successful can probably register the transfer by complying with the procedure outlined in the District Land Registrar's letter of 3rd April 1967. I am writing to you in the first instance to see what you think of such an application as, in acting for Marinate, you obtained for her an interest of some E65 in addition to her quarter share of Kehu's two-fifths interest in the Block. I am writing to you to ascertain whether you can possibly assist me towards completion of a transfer of the above land to Mrs. Boulton which transfer was provisionally confirmed by the Maori Land Court in 1947 but, for the reasons following, was never able to be finally confirmed and consequently registered. The purchase money at that time was E2.0 and was paid to Mango on the 23rd day of May, 1947. I enclose a copy of my letter of the 3rd March, 1967, to my New Plymouth agents and a copy of their reply of the 3rd April, 1967. These letters set out the history of the dealing as concisely as possible, the memo from the Court stating that as the original transfer was drawn against the parent title, the District Land Registrar would only accept a transfer for registration against a title to 1C. The total area of the original 68G 2D 2B 28 Block was just under 3000 acres and at the time of the repartition on the 24th March, 1960, all the subdivisions, with the exception of 68G 2D 2B 2B 5, 6, 7A and 7E had either been under provisionally confirmed sales or lease or later sold. The Court, for the purpose of allowing the sale to Mrs,DcWon to proceed, made the Partition Order to 1C in heifaVour although Succession Orders were or had been made to her other interests. The above was the position as I understood it in 1967 but, on again taking up the matter of completion with the Court, I found that a Succession Order had been made to Mango on the 2nd June, 1965, on your application, the value of the land being then shown, as far as I recollect, at E63.0 which, in the main, would be for stock yards and other improvements made by Mrs. Boulton. I think there was some monetary adjustment between the successors further to complicate the position, but you will no doubt have full particulars of this. I enclose copies of my submissions in support of the re-partition applications in 1960 and also of the Court Minutes

Nicholson, Kirkby, Sheat Ewart, Solicitors, Box 68, NEW PLYMOUTH Dear Sirs, RANGITOTO TUHUA 68,02D2B2B1c - Sale to Mrs Boulton I refer to the letter from Mr Hine to you dated 3 March, forwarded to me with your letter of 6 March. Before the transfer forwarded with your letter could be registered it would first of all be necessary to register a Paritition Order in order to crest a Land Transfer Title to the land in the name of the Vendor Mangu Waikohika alias Mangu Waretini. According to Mr Hine's litter and extract from the Minute Book of the Maori Land Court, enclosed, the appropriate Paritition Order in this case would be dated 24th March 1960 and would relate to Rangitoto Tuhua 68G2D2B2B1C, this Block having an area of 17 acres. The transfer however, on its face, re"ers to apiece of land described as part Rangitoto Tuhua 680202132B, the part in question being defined by a diagram endorsed on the transfer. As it is stated in your letter that Mangu Waikohika is now deceased it seems to me that it would not now be proper to amend the description :if the land in the transfer itself as consider this would be in conflict with Regulation 12 (3) of the Land Transfer Regulations 1966. An amendment made and initialled by the Judge under the seal of the Maori Land Court would not cure this defect for in my view the jurisdiction of the Court is limited to the matter specified in Section 227 of the Maori Affairs Act 1953 upon confirmation. It seems therefore that the third solution suggested in Mr Hine's letter of 3 March would strictly speaking be the more correct, namely for the original Partition Order dated 24 March 1960 to be cancelled under Section 184 of the Maori Affairs Act 1953 and a new Order made vesting the land in Mrs Boulton.
